DISTANCE SALES AGREEMENT

 

1. PARTIES

This Agreement is entered into between:

2. SUBJECT

The subject of this Agreement is the determination of the rights and obligations of the parties in accordance with the Law No. 6502 on the Protection of Consumers and the Regulation on Distance Contracts regarding the sale and delivery of handmade wooden wall clocks ordered by the BUYER from the SELLER'S website.

3. PRODUCT INFORMATION & PAYMENT

The products subject to this contract consist of handmade wooden wall clocks, the specific model, quantity, color, and sales price (including taxes) of which are stated in the order form at the time of purchase.

  • Payment Method: Credit Card / Debit Card (Processed via a secure 256-bit SSL encrypted payment gateway).

4. DELIVERY & SHIPMENT

  • Preparation Time: As the products are handmade, the processing and preparation time is 3 (three) business days.

  • Shipping Provider: All international shipments are handled by ShipEntegra (via express air carriers like FedEx, UPS, or DHL).

  • Delivery Time: International deliveries (North America, Europe, etc.) are typically completed within an average of 10 business days after the shipment is dispatched.

  • The SELLER is responsible for delivering the product in good condition and in accordance with the qualifications specified in the order.

5. RIGHT OF WITHDRAWAL (RETURN POLICY)

  • The BUYER has the right to withdraw from this contract within 14 (fourteen) days of receiving the product without giving any reason, provided the product is unused and in its original packaging.

  • EXCEPTIONS: According to international consumer laws and Turkish Regulation on Distance Contracts, the right of withdrawal does not apply to products that are:

    1. Custom-made or clearly personalized based on the BUYER’S specific requests (e.g., custom engravings or unique design modifications).

    2. Damaged due to improper handling by the BUYER.

  • Return shipping costs for non-defective items are the responsibility of the BUYER.

6. PRIVACY & SECURITY

The BUYER'S personal and financial information is protected under our Privacy Policy. All payment transactions are carried out through a secure, encrypted payment gateway with SSL certification. No credit card data is stored on the SELLER's servers.

7. EVIDENCE & DISPUTE RESOLUTION

  • In case of any dispute, the digital records of the SELLER, the shipping manifest, and the Proof of Delivery (POD) provided by the carrier (ShipEntegra) shall be considered definitive evidence.

  • In the implementation of this Agreement, Consumer Arbitration Committees and Consumer Courts in the place where the BUYER or SELLER resides are authorized within the legal monetary limits.

Acceptance: By completing the purchase on www.cloksy.net, the BUYER is deemed to have accepted all the terms of this Agreement.

MESAFELİ SATIŞ SÖZLEŞMESİ

İşbu Sözleşme, aşağıda belirtilen taraflar arasında akdedilmiştir:

İşbu Sözleşme'nin konusu, ALICI'nın SATICI'ya ait web sitesi üzerinden elektronik ortamda siparişini verdiği el yapımı ahşap duvar saatlerinin satışı ve teslimi ile ilgili olarak 6502 sayılı Tüketicinin Korunması Hakkında Kanun ve Mesafeli Sözleşmeler Yönetmeliği hükümleri uyarınca tarafların hak ve yükümlülüklerinin belirlenmesidir.

3. ÜRÜN BİLGİLERİ VE ÖDEME

Sözleşme konusu ürünler, ALICI tarafından sipariş esnasında seçilen model, miktar ve özelliklerdeki el yapımı ahşap duvar saatleridir. Ürünlerin vergiler dahil satış fiyatı sipariş formunda belirtildiği gibidir.

  • Ödeme Yöntemi: Kredi Kartı / Banka Kartı (256-bit SSL şifrelemeli güvenli ödeme altyapısı üzerinden gerçekleştirilir).

4. TESLİMAT VE GÖNDERİM

  • Hazırlık Süresi: Ürünler el yapımı olduğu için siparişin hazırlanma süresi ortalama 3 (üç) iş günüdür.

  • Lojistik Sağlayıcı: Tüm uluslararası gönderiler ShipEntegra (FedEx, UPS veya DHL gibi ekspres taşıyıcılar aracılığıyla) üzerinden gerçekleştirilir.

  • Teslimat Süresi: Uluslararası teslimatlar (Kuzey Amerika, Avrupa vb.), ürün kargoya verildikten sonra ortalama 10 iş günü içerisinde tamamlanmaktadır. Türkiye için 3 gündür.

  • SATICI, ürünü sağlam, eksiksiz ve siparişte belirtilen niteliklere uygun olarak teslim etmekle yükümlüdür.

5. CAYMA HAKKI VE İADE KOŞULLARI

  • ALICI, ürünü teslim aldığı tarihten itibaren 14 (on dört) gün içinde herhangi bir gerekçe göstermeksizin ve cezai şart ödemeksizin sözleşmeden cayma hakkına sahiptir. İade edilecek ürünün kullanılmamış ve orijinal ambalajında olması gerekmektedir.

  • İSTİSNALAR: Mesafeli Sözleşmeler Yönetmeliği uyarınca, aşağıdaki durumlarda cayma hakkı kullanılamaz:

    1. ALICI'nın istekleri veya kişisel ihtiyaçları doğrultusunda hazırlanan, kişiye özel hale getirilen veya üzerinde değişiklik yapılan ürünler (Örn: üzerine isim yazılan veya özel tasarım değişikliği yapılan saatler).

    2. Tesliminden sonra ALICI tarafından zarar verilen ürünler.

  • Ayıplı/kusurlu ürünler dışındaki iadelerde kargo ücreti ALICI'ya aittir.

6. GİZLİLİK VE GÜVENLİK

ALICI'nın bilgileri Gizlilik Politikamız kapsamında korunmaktadır. Ödeme işlemleri SSL sertifikalı güvenli ödeme geçidi üzerinden yapılır. ALICI'ya ait kredi kartı bilgileri SATICI'nın sunucularında tutulmaz.

7. DELİL SÖZLEŞMESİ VE YETKİLİ MAHKEME

  • Her türlü uyuşmazlıkta SATICI'nın dijital kayıtları, kargo manifestoları ve taşıyıcı firma (ShipEntegra) tarafından sağlanan Teslimat Belgesi (Proof of Delivery) kesin delil sayılacaktır.

  • İşbu Sözleşme'nin uygulanmasında, Ticaret Bakanlığı tarafından ilan edilen değere kadar Tüketici Hakem Heyetleri ile ALICI'nın veya SATICI'nın yerleşim yerindeki Tüketici Mahkemeleri yetkilidir.

Kabul Beyanı: ALICI, www.cloksy.net sitesi üzerinden siparişini tamamladığında işbu sözleşmenin tüm şartlarını kabul etmiş sayılır.
